GENERAL COMMENTS

  1. Children ages 11 – 17 can participate in Heritage STEM Camps (HSC) 1(one) week programs.

  2. All parents are required to read, sign and explain to the children the set of rules and Code of Conduct that shall be emailed to them timely before the start of any HSC program.

  3. The language spoken at the camp is English, therefore a basic knowledge of English is a pre-requisite to participation. By accepting this Term and Conditions you confirm the ability of your child to have sufficient language skills for participating in HSC Programs.

  4. Parents agree to support HSC Program by encouraging their child to abide by the highest standards of positive conduct. They will discuss constructive concerns, if any, regarding HSC Programs,

  5. Parents agree to pay for property damage caused directly, or indirectly, as a result of negligent action of their child.

 

1. INTRODUCTION

The Website Standard Terms and Conditions written on this webpage shall manage your use of this website. These Terms will be applied fully and affect your use of this Website. By using this Website, you agreed to accept all terms and conditions written herein. You must not use this Website if you disagree with any of the Website Standard Terms and Conditions. These terms and Conditions set forth obligations applicable to both parents and children attending HSC Program organized by the company of Heritage STEM Camps.

2. CANCELLATION POLICY

  • If camper cancels for any reason before [DATE], a full refund will be sent to the participant, less the application deposit.

  • If camper cancels for any reason 60 days prior to the program start date, 100% of the program fee is refunded (less the application deposit).

  • If camper cancels for any reason 30 days before the start of the program, a 50% of the program fee is refunded (less the application deposit). 

  • Campers canceling within two weeks of the start of the session are not eligible for a refund with the exception of documented medical reasons. For medical reasons, the program fee will be returned less the application deposit. Written documentation must be submitted within 10 days of cancellation.

  • By payment of any sum to Heritage STEM Camps, you are acknowledging your agreement to the Terms and Conditions of HSC as described herein.

 

2. INTELLECTUAL PROPERTY RIGHTS

Other than the content you own, under these Terms, HSC and/or its licensors licensees own all the intellectual property rights and materials contained in this Website.

You are granted limited license only for purposes of viewing the material contained on this Website.

3. RESTRICTIONS

You are specifically restricted from all of the following

  • publishing any Website material in any other media;

  • selling, sublicensing and/or otherwise commercializing any Website material;

  • publicly performing and/or showing any Website material;

  • using this Website in any way that is or may be damaging to this Website;

  • using this Website in any way that impacts user access to this Website;

  • using this Website contrary to applicable laws and regulations, or in any way may cause harm to the Website, or to any person or business entity;

  • engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website;

  • using this Website to engage in any advertising or marketing.

 

Certain areas of this Website are restricted from being accessed by you, and HSC may further restrict access by you to any areas of this Website, at any time, in its absolute discretion. Any user ID and password you may have for this Website is confidential and you must maintain confidentiality as well.

 

4. YOUR CONTENT

In this Website, Standard Terms and Conditions, “Your Content” shall mean any audio, video text, images or other material you choose to display on this Website. By displaying Your Content, you grant HSC a non-exclusive, worldwide irrevocable, sub licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be your own and must not be invading any third-party’s rights. HSC reserves the right to remove any of Your Content from this Website at any time without notice.

5. NO WARRANTIES

This Website is provided “as is,” with all faults, and HSC expresses no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.

6. LIMITATION OF LIABILITY

In no event, shall HSC, nor any of its officers, directors and employees, be held liable for anything arising out of, or in any way connected with your use of this Website whether or not such liability is under contract.  HSC including its officers, directors and employees shall not be held liable for any direct, indirect, consequential or special liability arising out of or in any way related to your use of this Website.

 

7. INDEMNIFICATION

You hereby indemnify to the fullest extent HSC from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising out of, or in any way, related to your breach of any of the provisions of these Terms.

 

8. SEVERABILITY

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

9. VARIATION OF TERMS

HSC is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

10. ASSIGNMENT

HSC is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

 

11. ENTIRE AGREEMENT

These Terms constitute the entire agreement between HSC and you in relation to your use of this Website, and supersede all prior agreements and understandings.

 

12. GOVERING LAW & JURISDICTION

These Terms will be governed by and interpreted in accordance with the laws of the State of North Carolina, and you submit to the non-exclusive jurisdiction of the state and federal courts located in North Carolina for the resolution of any disputes.

 

13. PRICES

All prices are in US Dollars. Prices may change without notice from time to time and by location. The total amount due is inclusive of sales tax applied in accordance with applicable regulations.

 

14. FORCE MAJEURE

Provider shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control due to any case beyond our reasonable control including lock-outs, strikes, shortages of personnel, labor disputes, war, riot, act of GOD, civil commotion, terrorism, malicious or direction, accident, environmental contamination, pandemic outbreak of disease, breakdown of plan or machinery, fire, flood, storm, difficulty or increased expense in obtaining workmen, materials, goods or raw materials in connection with the performance of this agreement. . No refund will be made, except at HSC’s discretion.

15. ERRORS AND INACCURACIES

Our goal is to provide complete, accurate, and up-to-date information on our website. Unfortunately, it is not possible to ensure that any website is completely free of human or technological errors. This website may contain typographical mistakes, inaccuracies, or omissions, some of which may relate to pricing and availability, and product information. We reserve the right to correct any errors, inaccuracies or omissions, including after an order has been submitted, and to change or update information at any time without prior notice.

 

16. GENERAL

If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provision of these Conditions and the remainder of the provision in question shall not be affected.

 

17. CHILD PROTECTION

HSC will contact local authorities if we suspect abuse or in an event of a disclosure. It is your responsibility to give HSC information (name, address and other contact details) of every person who is a parent and/or guardian and/or has parental responsibilities for the Camper. It is also your responsibility to tell us whom the Camper normally lives with.

18. PERSONAL SEARCHES

HSC reserves the right to search the bags and other personal property of all Campers in appropriate circumstances.

​

19. PUBLICITY

You acknowledge that HSC may use for publicity purposed and without prior notification any photograph or video taken of the Camper at the Location, and any statement (whether written or oral) made by you or the Camper.

​

20. JEWELRY, ELECTRONICS, VALUABLES AND LOST PROPERTY

HSC will not be liable for any items of jewelry, electronics or other valuable property brought to the Location by the Campers.

21. MEDICAL AND BEHAVIORAL

In the event of any medical or behavioral incident involving the child prior to the commencement of the camp, HSC reserve the right not to accept your booking on the grounds that any such medical or behavioral problems are not conducive to the camper or other camper’s participation in the camp.

 

In the event that the Camper becomes ill or incapacitated during the camp, you agree to medical treatment being provided to the camper if required in accordance with the recommendations of a qualified medical practitioner, including the administration of a general anesthetic and to surgical operations in case of emergency. Such action shall be taken at your expense. Permission is also granted for routine medical care for the camper by HSC personnel of any prescribed medication which the Camper brings to the Camp or which is prescribed while at the camp, or the use of over the counter medication when needed.

 

If the camper becomes ill or comes into contact with any contagious or infectious disease during the 12 days prior to the commencement of the Camp, you must immediately notify HSC in writing and provide a medical certificate from the Camper’s doctor giving approval for the Camper to participate in the Camp.

 

It is your and the Camper’s responsibility to help HSC prevent the spread of infectious diseases.

 

On request, you will provide a doctor’s letter stating a Camper’s suitability to participate in the camp.

 

It is your responsibility to tell HSC prior to the camp of any issue or condition that may affect their stay at the camp. These include but are not limited to ADHD, SEN, medical issues, language disabilities, physical or mental disability, diet, behavioral/social issues, and/or other concerns in the child’s history.

 

22. TRAVEL

In the event that the camper requires a VISA, you take full responsibility for ensuring you obtain a VISA. In the event that you do not obtain a VISA, it is deemed that you have cancelled your booking and your booking will be subject to our Cancellation Policy.

 

Open returns cannot be accepted, please book a return ticket on the stated arrival and departure dates.

23. SUPPLY OF SERVICES

HSC shall provide the Services to the Camper subject to these Conditions. By booking and paying the deposit you agree on behalf of yourself and the Camper to be bound by these Conditions. These Condition constitute the entire agreement between HSC and you/the Camper and may not be varied except in writing by the Program Leader of HSC.

 

You shall fully complete the registration form and at your own expenses supply HSC with all necessary and other information required by HSC in connection with the Services.

 

HSC may correct any typographical or other errors or omissions in any HSC material relating to the provision of the Services without incurring any liability to you.

 

24. PAYMENT AND FEES

You shall pay HSC the fees and other additional sums that are agreed between you and HSC for the provision of the Services.

 

Deposit must be remitted together with the registration form. The deposit is NOT refundable unless your booking is not accepted by HSC. No booking is valid until payment has been received, whether bank transfer, credit card or check.

 

Once acceptance of your booking is complete, HSC will issue an invoice or confirmation letter for the balance of the services.

 

The Full Fee Date for the balance of the program is 30 days prior to the start of the program. If HSC does not receive the balance by the full Fee Date, it will have the right to terminate this agreement on written notification to you. In the event of such termination (and in accordance with the above paragraph), the Deposit WILL NOT BE REFUNDED.

INSERT PAYMENT SCHEDULE

 

Payment includes but is not limited to the following: accommodation, food, counselors, instructors, entertainment, and activities, STEM activities, field trips (transportation) and entertainment.

 

Services not included are, but are not limited to the following: transportation to and from home location, pocket money, souvenirs, health insurance, medical expenses, airport pick-up or drop-offs, visa applications and xxx

 

25. LIABILITY

Except in respect of death or personal injury caused by HSC negligence, HSC shall not be liable to you or the Camper by reason of any representation (unless fraudulent) or any implied warranty, condition or other terms or any duty at common law or under the express terms of this Agreement for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by or negligent or the negligence of our servants, or agents or otherwise) which arise out of or in connection with this Agreement shall not exceed the amount of our Fees for the provision of the services.

 

Where HSC provides, in connection with provision of the services any goods or equipment or services by a third party, HSC does not give any warranty, guarantee or other terms as to their quality, fitness for purpose, performance or otherwise.

 

HSC shall have no liability to the Camper for any loss, damage, costs, expenses or other claims for compensation arising from any instructions supplied by you which are incomplete, incorrect, inaccurate or illegible, or arising from the Camper’s late arrival or non-arrival, or any other fault of you or the Camper.

 

HSC shall not be liable to you or be deemed to be in breach of contract due to any delay in performing, or any failure to perform, any of HSC obligations in relation to the Services, if the delay of failure was due to any cause beyond HSC’s reasonable control.

 

We advise you to take out travel insurance covering you against cancellation, curtailment, person liability, personal accident and loss of property.

 

HSC reserves the right to alter programs, activities, itineraries, excursions, age brackets, premises and personnel as it deems fit and without notice.

 

HSC will not be bound by any statement unless it is in writing and authorized by a director of HSC.

25. COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13 years old, the COPPA puts parent in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.
